You can exercise your rights to opt-out of those uses here. Please note that if you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out for the device and browser that you use to visit the website. • Objection to Processing and Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.
  • Withdrawal of Consent: Where we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

To learn more about how Shopify uses your personal information and any rights you may have, including rights related to data processed by Shopify, you can visit https://privacy.shopify.com/en.

Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. For the EEA, you can find a list of the responsible data protection supervisory authorities here.

International Transfers

Store operation, marketing, analytics and customer support may involve processing outside the EEA, particularly in Canada and the USA. The following safeguards are relevant to providers used in our store:

  • Shopify: for transfers from the EEA between Shopify group companies, Shopify uses Binding Corporate Rules (BCRs); for other transfers, an adequacy decision or Standard Contractual Clauses applies depending on the recipient and country. See the Shopify Data Processing Addendum and subprocessor list.
  • Klaviyo (email marketing, USA): its Data Processing Agreement provides for the EU–US Data Privacy Framework for covered transfers while applicable, and Standard Contractual Clauses for transfers that cannot be covered by that framework.
  • Re:amaze (customer support, USA) and Elevar/Audiense (analytics and related marketing services, USA): their agreements provide for Standard Contractual Clauses for relevant transfers to countries without adequate protection; see the Re:amaze DPA and Audiense DPA. The Re:amaze agreement gives priority to the Data Privacy Framework where it covers the particular transfer.

We also use Yanet Returns & Exchanges to manage returns. The provider lists a location in Vietnam in the Shopify App Store; its privacy policy describes access to customer and order data needed to provide the app. Transfers outside the EEA are subject to Chapter V GDPR; using an app or agreeing to this policy is not itself a transfer mechanism.

You may request information about a specific recipient, processing country and a copy of the relevant safeguards at info@dragonflybrand.com. Transfers subject to UK data protection law require the corresponding UK safeguards or an applicable adequacy decision. Consent rules for optional cookies and marketing apply independently of international-transfer safeguards.

GDPR legal bases, cookies and retention

DRAGONFLY trading s.r.o., Business ID 28122232, VAT ID CZ28122232, is established in the Czech Republic. GDPR protection for processing in the context of this establishment is not limited to people resident in the EEA. Additional mandatory local rights remain unaffected. Merely visiting the store, purchasing, or accepting sales terms is not consent to optional cookies or marketing.

  • Orders, payments, delivery, customer accounts, returns and requested customer service: steps before a contract or its performance (Article 6(1)(b) GDPR).
  • Tax, accounting and statutory consumer obligations: compliance with legal obligations (Article 6(1)(c)).
  • Security, fraud prevention, and establishing, exercising or defending legal claims: our legitimate interests in secure trading and protection of rights, subject to a balancing of your rights and interests (Article 6(1)(f)). This basis does not replace consent where cookie or direct-marketing law requires it.
  • Optional analytics, advertising cookies and related profiling: consent where required (Article 6(1)(a)); withdrawal is possible at any time without affecting prior lawful processing.
  • Electronic marketing: prior consent, or the permitted existing-customer exception for our own similar products where applicable, with a simple opt-out at collection and in every message. Relevant stricter local requirements apply. Consent-based marketing is optional and refusal does not prevent purchase.

Necessary cookies support the cart, checkout, security and services you expressly request. Optional analytics and advertising cookies require your consent where the law requires it. You can give, refuse or change consent through the cookie controls available on the site; for assistance or to exercise rights contact info@dragonflybrand.com. We use Pandectes for cookie-consent management alongside the Shopify privacy settings. Browser controls can also delete cookies; deletion alone does not necessarily withdraw consent recorded for an account.

Retention periods

Retention is determined by the purpose and type of record; a statutory duty to retain a document does not mean that all related customer data is retained for the same period:

  • Tax and accounting records: VAT documents are retained for 10 years from the end of the tax period in which the supply took place; OSS records for 10 years from the end of the calendar year of the supply. Accounting documents not subject to a longer statutory period are retained for 5 years from the end of the relevant accounting period. Statutory grounds for extending retention remain applicable.
  • Orders, complaints, returns and correspondence: for performance of the contract or resolution of the matter; afterwards, only data needed for statutory retention or legal claims. For claims under Czech law, the general limitation period is 3 years from when the right could first be exercised, taking account of the statutory rules on the entitled person's knowledge. This does not automatically mean 3 years from the order. If a different period applies, a period is suspended or starts again, or a dispute is ongoing, necessary evidence is retained accordingly, only for as long as protection of the relevant claim requires.
  • Customer accounts: for the life of the account; after closure, only data still needed for the retention duties or legal claims described above.
  • Marketing: until consent is withdrawn, an objection to direct marketing is made, or the purpose ends, whichever occurs first. Evidence of consent or an objection is kept while relied upon and afterwards only for related legal claims as described above. A minimal suppression record is kept for as long as needed to prevent further unwanted marketing; it is not used for marketing.
  • Cookies: until the individual cookie expires or is deleted earlier. Withdrawing consent ends further processing based on that consent; data retained on another lawful ground follows that ground. Details of individual cookies and their durations are available through the cookie-management tool or from info@dragonflybrand.com.

Providing identification, delivery and payment details is necessary to process an order; without the necessary details we cannot fulfil it. Optional fields and marketing consent are not a condition of purchase. A person at Dragonfly decides whether to refuse or cancel an order on suspicion of fraud. Any automated risk indicators serve as supporting information, not as the sole decision-maker. Advertising personalisation does not itself decide whether we accept or cancel your order.

You may request details and a copy of the applicable safeguards for an international transfer from us at the contact above. GDPR requests are normally answered within one month; a lawful extension of up to two further months for complexity or number of requests is notified with reasons within the first month. You may complain directly to a supervisory authority, including Úřad pro ochranu osobních údajů, Pplk. Sochora 27, 170 00 Praha 7, Czech Republic, posta@uoou.gov.cz, uoou.gov.cz, or the authority in your habitual residence, workplace or place of alleged infringement. You need not contact us first. You may object to direct marketing at any time; this processing then stops.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.
