Terms of service

1. Seller and scope

The seller is DRAGONFLY trading s.r.o., Dalimilova 1950/1a, 370 06 České Budějovice, Czech Republic, Company ID 28122232, VAT ID CZ28122232, registered with the Regional Court in České Budějovice, Section C, File 18524. Contact: info@dragonflybrand.com, +420 777 500 441.

These Terms govern purchases of goods by consumers through the Dragonfly online store. Purchases made for business purposes are governed by the separate B2B agreement, not these consumer Terms. Consumer status depends on the actual purpose of the purchase. Individually agreed terms prevail, subject always to mandatory consumer law.

2. Orders, prices and contract formation

The product page describes the goods, their price and availability. Available payment and delivery methods, delivery charges and the total payable to us are displayed before you place your order. Consumer prices include applicable taxes collected by us. For deliveries outside the EU, see the Shipping Policy for import charges that may be payable separately.

Select your goods and options, add them to your cart, enter the required details and choose payment and delivery. You can check and correct your details before submitting the order using the button indicating an obligation to pay.

We send confirmation to your email address. Unless that confirmation expressly states otherwise, it constitutes acceptance of your order and the contract is concluded.

We reserve the right to refuse an order before acceptance for a legitimate reason, in accordance with applicable law. A concluded contract may be changed or cancelled by agreement with you or where permitted by applicable law. Any payments due back to you following refusal of an order or cancellation of a contract will be refunded in accordance with the law.

The contract can be concluded in English, Czech, German or French as offered by the store. We retain the contract electronically. The complete internal contract archive is not directly accessible to customers. Your order confirmation and the relevant contractual information are provided electronically, and you can request information about your order at info@dragonflybrand.com.

3. Payment, delivery and risk

You must pay the total shown before placing your order using the selected payment method. Delivery arrangements are set out in the Shipping Policy. Unless another delivery time is agreed, goods will be delivered without undue delay and within 30 days of the contract. If delivery is late, your statutory rights, including to set an appropriate additional period and to end the contract where the legal conditions are met, remain unaffected. Where US shipment-delay rules apply, we will seek the required consent to a delay or cancel and promptly refund the unshipped goods.

Risk of loss or damage passes on delivery in accordance with applicable law. Where applicable mandatory consumer law requires physical possession, risk remains with us until you or a third party designated by you, other than the carrier, take physical possession. If you independently appoint a carrier not offered by us, risk passes on handover to that carrier only where the law permits.

Delivery without a signature, to a neighbour or to a safe place you have authorised, including outside your door, counts as proper delivery where it complies with your valid instructions and applicable law, including any required notification of the deposit. A delivery scan, signature, GPS record or photograph may be evidence of delivery. Once risk has lawfully passed, we are not responsible for subsequent theft, loss or damage not caused by our breach. This does not exclude claims for misdelivery, inaccurate carrier records or loss, damage or non-conformity arising before risk passed.

Please provide a complete, correct shipping address. If incorrect details or a failure to cooperate attributable solely to you cause reasonable, demonstrable additional delivery costs, we may claim them only to the extent permitted by law. We remain responsible for errors by us or a carrier acting on our behalf. Merely failing to collect or refusing a parcel is not in itself a notice of withdrawal. A valid statutory withdrawal is not subject to an administrative penalty or a blanket deduction of fulfilment charges.

4. Statutory withdrawal

Where applicable law, including applicable Czech, EU/EEA or UK consumer law, grants a statutory right of withdrawal, you may withdraw without giving a reason within 14 days from the day after you or a third party designated by you, other than the carrier, receive the goods. For goods ordered together but delivered separately, the period runs from receipt of the last item. Any longer statutory period remains unaffected. You may also withdraw before delivery.

To withdraw, send an unequivocal statement to info@dragonflybrand.com or to our postal address above. Sending your notice before the deadline is sufficient. You may use the model form below, but it is not compulsory. Withdrawal does not require our approval, a reason, an account or acceptance of the conditions for voluntary returns. Details are in the Returns and Refunds Policy.

Send the goods back without undue delay and no later than 14 days after notifying us. You bear the direct return shipping cost unless we have agreed otherwise or the law requires us to bear it. Returns of defective or incorrectly supplied goods are handled separately under section 6.

We reimburse payments received, including the cost of our least expensive standard delivery for withdrawal from the whole order, without undue delay and within 14 days after being informed. Supplementary charges for a more expensive delivery option are not refunded. We use the original payment method unless you expressly agree to another method without additional cost. We may withhold reimbursement until we receive the goods or evidence that you sent them back, whichever occurs first.

If you withdraw from only part of an order, original delivery charges are reimbursed to the extent required by applicable law; partial withdrawal does not automatically entitle you to reimbursement of all original delivery charges.

You are liable only for diminished value caused by handling beyond what is necessary to establish the goods' nature, characteristics and functioning, and only where the legal requirements, including the required information, are met. Original packaging, attached tags and an unused condition are not absolute conditions for statutory withdrawal.

Statutory exclusions apply only where their legal conditions are met, for example goods made to your specifications or clearly personalised goods, or genuinely sealed goods unsuitable for return for health or hygiene reasons after their seal is broken. Ordinary clothing is not automatically excluded merely because it has been tried on or its packaging opened.

5. Voluntary 90-day returns

Dragonfly offers eligible consumer purchases a voluntary return option from receipt until day 90, subject to the condition, exclusions and procedure in the Returns and Refunds Policy. It also covers the first 14 days where no statutory withdrawal right applies. It does not replace, shorten or impose additional conditions on statutory withdrawal or defect claims.

6. Defects, legal guarantees and complaints

Goods must conform to the contract and applicable statutory requirements. Under Czech law, you may complain about a defect that appears within two years of receipt. A defect appearing within the first year is presumed to have existed at receipt unless inconsistent with the nature of the goods or defect. The EU legal guarantee is at least two years; longer or more favourable mandatory rights in the relevant country remain unaffected.

You may request repair or replacement without charge, subject to the statutory rules on impossibility and disproportionate cost. Where legal conditions are met, including failure or refusal to provide an appropriate remedy, recurrence of a defect or a sufficiently serious defect, you may seek a proportionate price reduction or terminate the contract. Termination for an insignificant defect may be excluded by law. We bear the costs required by law for a justified defect claim. Normal wear and damage caused by the buyer are not defects for which we are liable. We give no additional commercial guarantee unless expressly offered.

Contact us at the email or postal address in section 1, identify the purchase, describe the defect and your requested remedy, and make the goods available for reasonable examination. A purchase can be proved by appropriate evidence; the original receipt or packaging is not the only acceptable proof. We provide the legally required complaint acknowledgements and outcome information. Under applicable Czech consumer law, the complaint, including remedy and notification, must be completed within 30 days unless you agree to a longer period in the individual case. If this period expires without completion, you may terminate the contract or request a proportionate reduction where the law provides.

Where UK mandatory consumer law applies, goods must be of satisfactory quality, fit for purpose and as described. The statutory remedies include a short-term right to reject faulty goods, normally within 30 days, and subsequent repair, replacement, price reduction or final rejection as provided by law. A two-year statement above does not cap applicable UK limitation periods. For consumers protected by French mandatory law, the statutory guarantee notice below applies.

Under Czech law, we are responsible in particular for conformity with the agreed description, type, quantity, quality and other agreed characteristics, suitability for the agreed purpose, and delivery of agreed accessories and instructions. Goods must also be suitable for their ordinary purpose, have reasonably expected characteristics including durability and safety, taking account of advertising and labelling, and match any sample or model provided. Statutory exceptions concerning public statements remain applicable. A departure from ordinary characteristics is effective only if specifically brought to the consumer’s attention and expressly accepted when the contract is concluded.

For a justified defect claim, the two-year period for a defect to appear and the one-year presumption period are suspended while the consumer cannot use the goods. We remedy defects within a reasonable time without significant inconvenience and take back the goods for that purpose at our expense. We may refuse both repair and replacement if remedy is impossible or disproportionately costly, considering in particular the defect’s significance and the value of conforming goods.

Under Czech law, a price reduction or termination is available if we refuse or fail to provide a proper remedy, the defect recurs, it constitutes a substantial breach, or it is clear that it will not be remedied within a reasonable time or without significant inconvenience. The reduction reflects the difference between the value of conforming goods and the defective goods supplied. Termination is unavailable for an insignificant defect; we bear the burden of proving insignificance. Following termination for a defect, we refund the price without undue delay after receiving the goods or proof of return dispatch. Until we fulfil our obligations concerning defects, the consumer may withhold any unpaid price or part of it.

Our written acknowledgement records the complaint date, its substance, the requested remedy and contact details for the outcome. The outcome confirmation records the date and method of resolution, any repair and its duration, or written reasons for rejection. A purchase may be established by appropriate evidence other than the original receipt. A justified defect claim entitles the consumer to reimbursement of reasonably incurred claim expenses under section 1924 of the Czech Civil Code. These are statutory rights, not an additional commercial guarantee; more favourable mandatory consumer rights remain unaffected.

7. Accessibility and personal data

The store enables browsing, selection of goods and variants, use of the cart, entry and correction of order details, payment and delivery selection, and order management. If you encounter an accessibility barrier or need information about the service in an accessible form, contact info@dragonflybrand.com or +420 777 500 441.

Information about the service and its accessibility features: product pages display names and prices as text, and legal information is available as HTML text structured with headings and links. A “Skip to content” link provides access to the main page content. Pages identify their language for assistive technologies and do not block normal browser zoom. These features assist navigation and reading.

On the pages checked, the product size can be selected using the keyboard, and the size chart can be opened with Enter and closed with Escape. The cart displays items, quantities and prices as text. Checkout provides named fields for contact, delivery and card details and makes the Terms available in a separate dialog. The check on 15 October 2026 also identified limitations: the order-number and email-or-phone fields in the Yanet returns form lack labels associated with them for assistive technologies, and some controls have missing or foreign-language accessible names. Full accessibility of all purchasing steps, identity verification and external payment services has not been confirmed.

The service is subject to Czech Act No. 424/2023 Coll., including requirements for a perceivable, operable, understandable and robust web service, accessible information, and accessible identification, security and payment functions. Information about the service and its accessibility is also provided in audio form on request under section 14 of that Act. Requests or reports of a barrier may be sent to the email address above or made by telephone.

Personal data and cookies are described in our Privacy Policy. Agreement to these Terms is not consent to optional marketing or cookies.

8. Consumer disputes and applicable law

Please first contact us about a complaint. Unresolved consumer disputes may be submitted to the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic, adr@coi.gov.cz, coi.gov.cz/informace-o-adr/. This does not restrict access to competent courts or other mandatory dispute-resolution rights.

The contract is governed by Czech law. This choice does not deprive consumers of mandatory protection under the law that would apply without that choice, particularly the law of their habitual residence where our activities are directed there. Nothing in these Terms excludes non-excludable liability, statutory remedies or mandatory rules on jurisdiction.

9. Changes and business purchases

Changes to these Terms apply only to future contracts. The version applicable when your contract was concluded continues to govern that contract.

For wholesale or other business purchases, contact us through Wholesale / B2B to agree the applicable B2B terms before ordering. The consumer withdrawal and voluntary 90-day return rules do not apply to business purchases unless separately agreed. For business shipments, unless otherwise agreed in writing, provided by the agreed Incoterm or required by mandatory law, risk passes when the goods are duly handed to the first carrier. This does not release us from liability for non-conformity, inadequate packaging or another breach existing before risk passed.

A choice of Czech law applies only to the extent that the competent court’s mandatory conflict-of-laws rules permit it. In particular, where Article 120 of the Swiss Private International Law Act applies, its exclusion of a choice of law and the law of the consumer’s habitual residence prevail. No exclusive Czech jurisdiction is agreed for consumers.

Protection of our rights and use of the website

The website and its content are protected by intellectual property law. Reproduction, distribution or commercial exploitation requires the rights holder’s permission unless permitted by law. You must not use the website unlawfully, infringe third-party rights, submit fraudulent information or interfere with its security or operation. We may restrict access where reasonably necessary to stop such misuse; this does not remove rights or obligations under an existing contract.

If your breach of a contractual or legal duty causes us loss, including through a justified third-party claim, we may seek compensation to the extent permitted by law. Any claim must reflect loss actually caused by your breach and may include reasonable, necessary defence costs where recoverable by law. You are not required to bear loss caused by our own breach or costs for which you are not legally liable.

Consumers protected by French mandatory law

The following statutory notice applies where French mandatory consumer law applies. The seller responsible is DRAGONFLY trading s.r.o., at the postal address, email and telephone stated in section 1. This is a legal guarantee, not an additional commercial warranty.

1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d'enlèvement du bien non conforme, ou s'il supporte les frais d'installation du bien réparé ou de remplacement ;

Effective from 15 October 2026
