Customs, import taxes and uncollected parcels
For delivery outside the EU, import duty, import taxes and carrier clearance fees may arise according to the destination, origin, classification and value of the goods. Unless expressly included in the total shown at checkout, charges legally payable by the recipient may be collected by the carrier or customs authority. Taxes which the seller is legally required to collect or pay remain the seller’s responsibility. In particular, a UK customs-duty threshold is not a general exemption from VAT or handling charges; no fixed euro equivalent or blanket exemption is promised.
Refusing or failing to collect a parcel does not itself communicate withdrawal. Please tell us clearly if you wish to withdraw. We do not automatically deduct fulfilment fees, penalties or all outbound shipping from a statutory refund. We may claim only reasonable, documented costs for which you are legally liable, with an explanation of the basis and amount; statutory withdrawal refunds and mandatory consumer protections, including those outside the EU, remain unaffected.
Uncollected parcels and deduction of transport costs
Refusing delivery or failing to collect a parcel is not in itself a notice of withdrawal and does not by itself end the contract. If you do not take delivery, do not notify us of a valid statutory withdrawal and cause us loss by breaching your obligation to accept a properly tendered delivery, we may claim the actual, reasonable and documented costs of the unsuccessful outward transport and the parcel's return to us, only to the extent permitted by applicable law.
If, following a valid termination of the contract, a payment becomes refundable to you, we will deduct these costs by setting off our lawful claim against that refund, but only where all legal conditions for set-off are met. Before doing so, we will tell you the legal basis, itemised calculation and due date of the claim and provide evidence of the costs on request. We will not unilaterally set off a claim unless it is due, sufficiently certain and otherwise eligible for set-off; an uncertain or indeterminate claim will not be deducted in this way.
This clause creates no flat penalty or handling fee. We claim only costs that we actually remain out of pocket for, without double charging or amounts otherwise reimbursed. We do not charge you costs caused by our error or that of a carrier acting on our behalf; no claim arises where the failure to take delivery was not a breach of your obligation.
A valid statutory withdrawal, including withdrawal before taking delivery, and statutory refund rules remain unaffected. This clause does not authorise deduction of the original standard delivery charge or a penalty for exercising statutory withdrawal. Any direct return costs following statutory withdrawal are governed solely by the law and the required prior information. Mandatory consumer rights in the customer's country prevail.
This clarification applies to orders concluded after its publication on 4 November 2026. More favourable terms agreed for earlier orders remain unchanged.
Delivery and consumer protection
The stated transit times are estimates in business days, unless a binding delivery date is expressly agreed. Product-specific dispatch times are shown with the product. Unless agreed otherwise, we deliver without undue delay and within 30 days of the contract. Statutory remedies for late delivery remain available. For US orders, if we cannot ship within the stated time (or within 30 days where no time is stated), we obtain any consent to delay required by law or provide the legally required refund.
Risk of loss or damage passes on delivery in accordance with applicable law. Where applicable mandatory consumer law requires physical possession, risk remains with us until you or a third party designated by you, other than the carrier, take physical possession. If you independently appoint a carrier not offered by us, risk passes on handover to that carrier only where the law permits.
Delivery without a signature, to a neighbour or to a safe place you have authorised, including outside your door, counts as proper delivery where it complies with your valid instructions and applicable law, including any required notification of the deposit. A delivery scan, signature, GPS record or photograph may be evidence of delivery. Once risk has lawfully passed, we are not responsible for subsequent theft, loss or damage not caused by our breach. This does not exclude claims for misdelivery, inaccurate carrier records or loss, damage or non-conformity arising before risk passed.
Please check your delivery details. Reasonable proven extra delivery costs caused solely by incorrect details you supplied or failure to cooperate may be claimed only where permitted by law. Reporting damage promptly helps investigation but failure to report immediately to the carrier does not remove your rights against us. Contact info@dragonflybrand.com. See our Terms of Service and Refund Policy.
The B2B tariff above applies only to genuine business purchases under the separately agreed wholesale terms. It does not alter consumer delivery rights.
Refund of original delivery charges
If you exercise an applicable statutory right of withdrawal within its legal time limit, we refund the original delivery charges in the amount required by law; for a full EU statutory withdrawal, this is up to the cost of our least expensive standard delivery. A withdrawal notified in time remains a statutory withdrawal even if the parcel arrives later.
For returns under our voluntary 90-day option, we refund only the purchase price of the goods accepted for return. Original delivery charges are not refunded, unless mandatory law or an express agreement requires otherwise.
